1. Basic Provisions
1.1 The following terms and conditions apply to all contracts between Sportpaint and the customer of this website www.sportpaint.de. Only the following conditions of Sportpaint apply.
1.2 The contract language is German. Before submitting an order via the shop system, contract data can be printed or saved electronically.
2. Subject of Contract
The subject is the sale of goods. Product characteristics are listed in the item description and supplementary information on the Sportpaint website.
3. Conclusion of Contract
3.1 Product presentations by the provider on the Sportpaint website are non-binding.
3.2 The customer can submit a binding purchase offer (order) via the shop system. Items intended for purchase are placed in the shopping cart. Changes can be made at any time in the cart. After accessing the checkout page and entering personal data and payment/shipping conditions, all order data and costs are displayed again. Before submitting the order, the customer has the opportunity to review and change all information. By submitting the order via the “Buy Now” button, the customer makes a binding offer. The customer then receives an automatic email confirming receipt of the order, which does not yet constitute a contract.
3.3 Acceptance of the offer and thus the conclusion of the contract occurs through confirmation in an email confirming the execution of the order or delivery of goods (order confirmation).
3.4 The processing of the order and transmission of all information related to the contract is done by email. The customer must therefore ensure that the email address stored with Sportpaint is correct and that email reception is technically ensured and not prevented by spam filters.
4. Right of Withdrawal
Printed goods are excluded from returns. For unprinted goods, you have the right to withdraw from this contract within 14 days without giving reasons. The withdrawal period is 14 days from the day on which you or a third party named by you, who is not the carrier, took possession of the last goods.
To exercise your right of withdrawal, you must inform us, Sportpaint Werbeball BedruckungsGmbH & Co. KG, Am Voßberg 21, D-23758 Oldenburg i.H., Germany – Phone: 04361/5553975, Email: info@sportpaint.de, by means of a clear declaration of your decision to withdraw from this contract.
4.1 Consequences of Withdrawal
In the case of an effective withdrawal, the mutually received services are to be returned. If you cannot return the received goods in whole or in part or only in a deteriorated condition, you must compensate Sportpaint accordingly.

5. Right of Retention, Retention of Title
5.1 The customer may only exercise a right of retention insofar as it concerns claims from the same contractual relationship.
5.2 Goods remain the property of Sportpaint until full payment of the purchase price.
6. Warranty
6.1 Statutory provisions apply.
6.2 The customer must immediately inspect the goods upon delivery for completeness, obvious defects and transport damage and notify Sportpaint of any complaints without delay.
7. Liability
7.1 Sportpaint is not liable for the continuous availability of the website and the goods offered there.
8. Jurisdiction and Place of Performance
8.1 German law applies.
8.2 The place of performance for all services from business relationships with Sportpaint and the place of jurisdiction is Winsen/Luhe.
